Texas Trial Attorneys

Civil Litigation and Creditors’ Rights

At Wells & Cuellar, P.C., you are represented by a dedicated group of client-focused professionals whose complementary talents and experience provide comprehensive coverage of your legal and financial interests. Our lawyers have a range of experience from 15 years to nearly 40 years, which means we can assemble an effective team while also helping you control costs by billing some services at commensurately lower rates.

D. Brent Wells, president and founder of the firm, has been actively engaged in commercial litigation for almost 40 years. He has a reputation as a skilled trial lawyer and an energetic advocate for his clients, and he brings uncommon credentials to his law practice in debt collections, creditors’ rights, defense of consumer claims and resolution of business disputes. Brent is board certified in Commercial and Consumer Law by the Texas Board of Legal Specialization and nationally certified in Creditors’ Rights Law by the American Board of Certification. He has extensive experience in alternative dispute resolution, as a mediator, as well as a national arbitrator panelist for both the American Arbitration Association and the National Arbitration Forum.

Brent is a lawyer’s lawyer, routinely sought for complex civil litigation, bankruptcy adversary proceedings and civil appeals, and regularly consulting and educating legal peers on topics such as creditors’ rights, judgment collection, deceptive trade practices (DTPA) defense and consumer arbitration. He is also frequently called upon as a seminar trainer and speaker by diverse groups such as the National Association of Credit Management, the Texas Society of CPAs, the Texas Manufactured Housing Association, the National Petroleum Energy Credit Association and the International Energy Credit Association. He practices before all trial and appellate courts of Texas, including the Texas Supreme Court, and has litigated and argued cases across the United States in federal district courts, U.S. Bankruptcy Court and federal appellate court, and is admitted to practice before the U.S. Supreme Court.

A Team Approach to Achieving Client Goals

While Brent is the founder of the firm and our most senior trial attorney, we operate as a team rather than a hierarchy.

James E. Cuellar is an accomplished litigator and creditors’ rights lawyer who has practiced in business litigation, collections, bankruptcy and civil appeals for more than 30 years. James had the opportunity to clerk for a justice of the 5th U.S. Circuit Court of Appeals and, like Brent, has handled federal appeals and is qualified to practice before the U.S. Supreme Court.

Jeffrey D. Stewart has a complementary practice style and a range of experience focusing on the particular representational needs of the specific client. He has had success effectively advancing the interests of his clients in litigation and alternative dispute resolution.

The attorneys of Wells & Cuellar are supported by an experienced and proficient administrative staff under the direction of administrator Carole P. Wells and deputy administrator Tina M. Grant.
